Parties
These Terms & Conditions ("Terms") govern the relationship between THE YELLOW MUSHROOM S.R.L., a company registered in Romania under CUI 45260698, operating as Trust & Care Leadership School ("School", "we", "us"), and any individual or legal entity ("Participant", "you") who registers for or purchases access to any program offered through trustandcareleadership.eu.
By submitting a registration fee or a full payment, you confirm that you have read, understood, and agreed to these Terms.

Registration Process
Enrollment follows a structured process designed to ensure alignment between your goals and the program's scope:
-
1
Book a discovery call. Before any payment is made, we strongly encourage you to schedule a call with the facilitators via the Book a call button on the program page. This is your opportunity to discuss your context, expectations, and any questions before committing.
-
2
Pay the registration fee. Once both parties agree the program is a good fit, you secure your place by paying the registration fee indicated on the program page. Payment constitutes acceptance of these Terms.
-
3
Receive and sign the individual contract. Upon confirmation of payment, the School will send an individual contract by email. This specifies the remaining balance, payment schedule, start dates, and any program-specific conditions. The individual contract takes precedence over these general Terms in the event of conflict.
Paying the registration fee does not guarantee admission if, following the discovery call, there is a clear mismatch between your needs and the program format. In such cases, the registration fee will be refunded in full within 14 calendar days.
Pricing & Payment
All prices are quoted in EUR and are exclusive of VAT, unless stated otherwise. VAT will be applied in accordance with applicable Romanian and EU regulations.
Payment details (bank transfer, card, or other methods) are communicated at the time of registration and specified in the individual contract. Where instalment plans are offered, the schedule and conditions are defined in the individual contract. Failure to meet a payment deadline may result in suspension of access pending resolution.
Registration Fee
The registration fee is a non-refundable advance payment that reserves your place in a specific cohort edition, except in the circumstances described below.
The registration fee is transferable. If you cannot attend the edition for which you registered, you may:
- Transfer your place to another individual (subject to School approval);
- Transfer your registration to a future edition of the same program, subject to availability.
Transfer requests must be submitted by email at least 14 calendar days before the program start date.
The registration fee will be refunded only in the following cases:
- The School cancels the edition (see Section 7);
- The Participant is deemed not suitable for the program following the discovery call and the School declines admission (see Section 3).
Cancellation & Withdrawal by Participant
After signing the individual contract, participants who wish to withdraw should notify the School in writing as soon as possible.
| Withdrawal timing | Consequence |
|---|---|
| More than 14 days before program start | Registration fee is transferable (not refunded); any amounts paid beyond the registration fee are refunded in full within 14 calendar days. |
| 14 days or less before program start, or after the program has begun | Registration fee is forfeited; additional amounts paid are non-refundable unless otherwise agreed in the individual contract. |
Exceptions (e.g. serious illness, documented force majeure) will be assessed on a case-by-case basis and may result in a full or partial transfer to a future edition.
Cancellation or Rescheduling by the School
The School reserves the right to cancel or reschedule an edition if the minimum number of participants is not reached, or due to circumstances beyond its control. Participants will be notified as soon as possible by email.
In the event of cancellation or rescheduling by the School, each Participant may choose:
- A full refund of all amounts paid, within 14 calendar days of notification; or
- Transfer to a future edition of the same program, at no additional cost.
The choice is entirely yours.
Program Delivery & Participant Responsibilities
Programs are delivered online via video conferencing (Zoom or equivalent). Participants are responsible for ensuring they have the necessary hardware, software, and internet connection to participate fully.
Active participation is expected throughout each program. The School does not guarantee specific outcomes, as coaching and mentoring results depend on each individual's engagement and commitment.
Certificates of completion are awarded upon meeting the attendance and participation requirements specified in the individual contract or program documentation.
Intellectual Property
All program materials, frameworks, recordings (where provided), and content shared by the School are the intellectual property of THE YELLOW MUSHROOM S.R.L. and/or its licensed partners (including the Collective Shift methodology). Participants may use materials for personal learning only.
Reproduction, redistribution, resale, or derivative use of any program materials without prior written consent from the School is prohibited.
Confidentiality & Group Agreements
Group programs create shared spaces where participants may disclose personal or professional information. All participants are expected to respect the confidentiality of what is shared within the group.
The School applies the same standard and does not disclose participant information to third parties without consent, except where required by law.
Personal Data & Privacy
Personal data collected during registration and contracting is processed in accordance with Romanian law (Law no. 190/2018) and the General Data Protection Regulation (GDPR – Regulation EU 2016/679).
Data is used exclusively for the administration of enrollment, program delivery, and communication related to Trust & Care Leadership School activities. Participants may exercise their GDPR rights (access, rectification, erasure, etc.) by contacting the School at the address below.
Limitation of Liability
The School's liability is limited to the amounts paid by the Participant for the specific program in question. The School is not liable for indirect, consequential, or incidental damages arising from participation in, or failure to attend, a program.
Coaching and mentoring are not substitutes for psychological, medical, legal, or financial advice. Participants with clinical needs are encouraged to seek appropriate professional support.
Governing Law & Disputes
These Terms are governed by Romanian law. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Romania.
Participants who are consumers within the meaning of EU consumer protection law may also submit complaints to the National Authority for Consumer Protection (ANPC) or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
